Latar Belakang

Qbar didirikan di Padang Sumatera Barat (Sumbar) pada tanggal 4 Januari 2002 berdasarkan akte Nomor 05 dari notaris Hermon S.H. Namun embrionik kehadiran lembaga ini telah ada dan tumbuh jauh sebelum era reformasi bergulir (era yang dimulai semenjak runtuhnya rezim orde baru pimpinan suharto pada tahun 1998). Para pendiri dan penggagas lahirnya Qbar sebagian besarnya adalah mantan aktivis mahasiswa yang aktif dalam gerakan sosial dan demokratisasi pada tahun 1990-an yang mencapai momentumnya pada 1998.

Pada tahun 1996, sebagian besar penggagas dan pendiri Qbar mendirikan Lembaga Riset dan Advokasi (LRA). Lembaga LRA ini kemudian menjadi semacam icon perlawanan rakyat terhadap otoriterisme, penindasan dan ketidakadilan di Sumbar. LRA merupakan lembaga utama yang membidani lahirnya Serikat Petani Sumatera Barat (SPSB) dan Aliansi Masyarakat Adat Sumatera Barat (AMA-SUMBAR). Bersama kedua organisasi ini LRA melakukan upaya-upaya perjuangan pengembalian hak-hak (pemilikan dan pengelolaan sumber daya agraria, kemerdekaan berserikat dan berkumpul menentukan nasib sendiri dan lain-lain).

Setelah berjalan lebih dari 6 tahun, LRA dirasakan masih belum efektif membawa perubahan yang diharapkan. Melalui evaluasi dan refleksi yang mendalam disadari bahwa aktifitas dan agenda yang telah dilakukan selama ini sangat parsial dan sektoral. Perjuangan selama ini barulah pada level dan dataran pertempuran (battle) bukan pada level peperangan (war) Winnning In The Battle does not neccessalirily mean winning in the war.

Rezim otoriter dan refresif memang telah berhasil ditumbangkan. Tanah rakyat yang selama ini dirampas, sebagiannya telah berhasil direklaming oleh rakyat di berbagai daerah. Pendekatan keamanan yang selama ini digunakan sebagai metode yang sangat ampuh dalam membungkam dan mengkebiri kedaulatan dan hak azazi rakyat telah berkurang secara siknifikan. Namun, penindasan,  ketidakadilan, manipulasi politik dan ekonomi dalam berbagai bentuk dan wujud masih bercokol di muka bumi pertiwi ini.

Untuk itu, dipandang perlu sebuah format, orientasi, metode dan playing field baru perjuangan bagi perwujudan keadilan, demokratisasi dan penegakan hak azazi manusia yang merupakan elemen dasar (main ingredienst) dari penciptaan kemakmuran dan kesejahteraan rakyat. Setelah melalui proses persiapan dan pematangan, Qbar kemudian didirikan untuk menjawab tantangan itu.

Apa dan Kenapa Qbar ?

Tidak seperti lembaga atau organisasi lain, nama Qbar bukanlah sebuah singkatan (abbreviation). Kata Qbar berasal dari dua suku kata yaitu Q (equilibrium-keseimbangan) dan bar (line-garis). jadi Qbar berarti garis keseimbangan. Pilihan nama ini diambil atas kesadaran bahwa untuk mewujudkan sebuah sistem yang demokratis dan adil perlu adanya keseimbangan.

Dalam ranah pergerakan dan perjuangan, Qbar tidak ingin terjebak pada isu dan aktifitas parsial dan sektoral. Perhatian dan kerja ke depan mestilah holistik, integral dan sinergis. Semua unsur dan elemen yang ada di dalam sistem mesti diseimbangkan. Tidak mungkin akan menghasilkan suatu tata kepemerintahaan yang baik bila hanya mengganti dan mengutak-atik para penyelenggaranya saja tanpa dibarengi dengan penguatan dan pemberdayaan rakyat serta produksi hukum dan kebijakan yang mampu mendorong terwujudnya hal itu.

Pada dataran dan tingkatan tertentu, berhadapan secara frontal dengan penyelenggara negara bukanlah sebuah pilihan bijak. Berdialog, membangun saling pengertian dan kepercayaan serta membangun aliansi taktis dan strategis diantara semua stakeholders negara merupakan sesuatu yang harus dijadikan pertimbangan.

Visi

Terwujudnya tatanan kehidupan kebangsaan dan kerakyatan yang adil dan demokratis untuk mencapai masyarakat yang adil , makmur dan sejahtrera.

Misi

Lahirnya hukum dan kebijakan untuk memenuhi keadilan, kemakmuran dan kesejahtraan bagi rakyat, semakin kuatnya rakyat untuk memenuhi keadilan, kesejahtraan dan kemakmuran dan menguatnya kemampuan Qbar dalam mencapai visinya.

Semua hal itu akan diperjuangkan melalui (1) fasilitas proses menumbuhkan dan peningkatan kapasitas pemerintah dalam pembuatan hukum dan kebijakan yang responsif dalam memenuhi keadilan dan kesejahteraan. (2) fasilitas penguatan basis (rakyat) untuk memenuhi keadilan, kesejahteraan, dan kemakmuran serta pengembangan, dan (3) penguatan institusi Qbar.

Bentuk dan Struktur Organisasi

Qbar merupakan organisasi non pemerintahan yang bersifat nirlaba, independen dan non partisipan. Bentuk organisasi Qbar adalah perkumpulan. Kekuasaan pengambilan keputusan tertinggi dan fungsi legislasi organisasi berada pada Rapat Umum Anggota (RUA) yang diadakan setiap 3 tahun sekali. Fungsi pengawasan dan kontrol berada pada Majelis Anggota. Sementara fungsi eksekutif dimandatkan dan dijalankan oleh direktur eksekutif (bersama perangkat-perangkat pelaksana yang dibentuk dan diangkat oleh direktur eksekutif). Majelis Anggota dan direktur eksekutif dipilih, diangkat, dimintakan pertangungjawabannya serta diberhentikan melalui rapat anggota.

Foundation Profil

Background

Legally, Qbar was formed in Padang, West Sumatra, on January 4^th, 2002, based on the act No. 05 from notary Hermon, SH. But, the embryonic of this institution had been felt and grown a long time ago before reformation era. Most of the pioneers of Qbar were the graduated college students which were energetic persons and actively involved in a social and democracy campaign in 1990s (and reached the momentum in 1998). In 1996, almost all of these persons formed Lembaga Riset Advokasi (LRA) – Advocation Research Institution – via LRA, all of the potency of college students and civil society in West Sumatra were accumulated. Then LRA became one of the icon with otoritarism fighting and unjuctice. LRA was the first foundation whose makes born unitied farmer in West Sumatera and AMA-Sumbar as aspiration of community in marginal with the system of government use otoriter and represives. So that, it could be the effective and efficient toward the national life.

After 6 year, LRA still has not to work make some change that wanna be. From evaluation and reflection in deep, we realize the activities and agenda was done for along time very parsial and sectoral. This fighting foe along time was to the war and battle not to level war in summary “Winning in the battle does not necessarily mean winning in the War”. Otorism and represif was work to break down. The community land was has robe from the community. And ready to reaclaming with the community in many city. The system was using for a long time as metod very work to make the in the human right as significant. Although unjuctice, manipulation in politic and economic in many form still has exist in Indonesia . For that we need to make a new formula, orientasion, metod, ad playing field to fight to make a new juctice, democration and human right as a main ingredients to make secure and prosperous for the society. After many process Qbar was establish to ask all of this problem.

What and Why Qbar?

Not just like in the name of the foundation as usually, the name of Qbar was not abbreviation. The word of Qbar was from 2 work Q (Equilibrium) and bar (line). So Qbar it means Line of the Equilibrium. We were Choosing of the name from the relazing to make a system with democration and fair was need equilibirium. The nature teach us to equilibrium to system of nature. In the Universe system, the balance of sub-system  is needed absolutely. The disturbances of the natural  balance will drive natural disasters and riots. Identically, the balance of one nation /country also needed to guarrant the citizenship living. It is believed that lacking of reformation was caused by the unbalanced system  in government. Yet, the balance system in government have not built.  “The government actors” (the government officer, red) in  every level still dominate the process of decisions taking and decision making, either law drafting or policy drafting.  Active participation from citizens (people) in all processing of  decision making and decision taking (for every regulations)  is still not  covered properly.  It was just a lip service and slogans.  The for stabilizing and repairing the dangling economic condition answered by increasing economic growth (paradigm) and driving of investing higher capitals from overseas. But, what the government did in economic decision not balanced with ecosystem, natural resources and human right. There is no ecosystem protection, no human resources protection and no human right protection including how people acquire their human rights (as if it is denied).  The sustainable development is just be for debate

In the moving site and fighting site, Qbar doesn’t want to be trapped at issues and activities of sectors and partials. The future targets and work plans must be holistic, integrated, and synergic. All of system elements must be balanced. It is not possible for Indonesia having good governance, if our government just change or reshuffle the cabinet (officers, red) without strengthening and empowering people and issuing legal and policies.  The legal and policies must have drive and stimulate effectiveness, efficiency, transparency, and accountability the government. At under any circumstances, people (citizens) and the government  vis a vis frontally, it is not wise choice. Dialogue is one of alternative good choice. Dialogue will help people to eiter understand or trust each other.  Dialogue is also helped to make strategic alliances for all stakeholder is needed.

     To realize a set of national life which is fair and democracy in order to reach the fairness and wealthy of the society

Mission

     The birth of law and policy to fulfill justice, secure and prosperous for the society; the stronger the people will to fulfill justice, secure and prosperous the stronger Qbar ability in reaching its vision. All of these things can be reaching by (1) facilitation develop and increase government capacity process in responsive law and policy making in fulfilling  justice and secure; (2) facilitation base empowerment (society) to fulfill justice, secure and prosperous, and also development, and (3) Qbar institution reinforce.

Formation and structure of organization.   

Qbar was a non government organization with not for profit, independent and not affiliated to or underbow of any political party and interest group. Qbar’s form was a foundation. The highest power of decision making and act of organization legislation is under assembly meeting pleno which held once in 3 years. The act of monitoring and controlling is under Assembly. While the act of executive is mandated and run by the executive director (helped by all of official team member which).The chosen assembly  and the the chosen executive director, appointed and alleged to his accountability and fired through assembly meeting pleno.
